TERMS AND CONDITIONS FOR USE OF THE WEBSITE

You are visiting the pages of the DCI Group website (hereinafter the “Website”). As a user of the Website (hereinafter the “User” or “you”), you are subject, without limitation or reservation, to the following terms of service (hereinafter the “Terms of Service”), as well as to legal and regulatory provisions in force.

The DCI Group (“DCI”) may revise these Terms of Service at any time by updating this Website page. You are bound by any such revisions and should therefore periodically visit this page to review the Terms of Service applicable when you visit the Website.


1- Ownership of the Website

The entire Website and all of its constituent elements, i.e., the software and content such as text, graphics, videos, animated or still images, sounds, icons, processes, products, technology, know-how, graphics, downloadable documents, trademarks, logos and domain names are the exclusive property of DCI or its licensors.

Any total or partial use, copy, representation, reproduction, publication, downloading, display, transmission, distribution and/or modification of the Website without DCI’s express permission is prohibited and would constitute an infringement sanctioned by Article L. 122-4 of the French Intellectual Property Code, subject to being expressly authorised by French law (including under Article L122-5 of the French Intellectual Property Code).

Similarly, it is strictly forbidden to use or reproduce the name DCI and/or its logo, as well as any version derived from them. These trademarks/logos are protected by copyright and are registered with Intellectual Property offices. Any total or partial reproduction of such trademarks and/or logos without DCI’s express permission is prohibited in accordance with the provisions of the French Intellectual Property Code.

This restriction also applies to any trademarks and/or logos of DCI’s commercial partners appearing on the Website. Certain names mentioned may be protected by third party trademark rights, without any mention of such protection being necessarily indicated. You are therefore required to comply in all circumstances with any restrictions of use relating to trademark law.

The databases appearing, where applicable, on the Website are protected by the provisions of Law No. 98-536 of 1 July 1998 transposing into the French Intellectual Property Code Directive 96/9/EC of the European Parliament and of the Council dated 11 March 1996 on the legal protection of databases. Any total or partial representation of these databases without DCI’s express permission would constitute an infringement.

2- Access to the Website

Access to and use of the Website is solely at the User’s risk. Neither DCI nor any other party involved in the creation of the Website may be held liable for any direct or indirect, material or immaterial, special, specific or incidental damages, whatever their cause(s), resulting from access to the Website, inaccessibility of the Website, access to any linked Website (including by hypertext link), any inaccuracy of the information contained on the Website or on any hyperlinked website, any viruses transmitted during access to and use of the Website and/or downloading of any content. Furthermore, the User expressly acknowledges and agrees that DCI shall not be held liable for any defamatory, offensive or illegal content, data, text, images, video or audio posted on the Website by any third party.

Furthermore, the User is informed that, during their visits to the Website, a cookie may be automatically installed on their browser. For more information on cookies, please consult the Website’s “Cookies” section.

3- Information on the Website

DCI makes every effort to provide the User with quality and verified information. However, the information provided is for information purposes only. DCI makes no guarantee, whether express or implied, as to the nature, accuracy, precision, updating or completeness of the information made available on the Website, or as to its suitability for any particular purpose. DCI cannot undertake to update or correct in real time the information published on the Website. However, if any information appears to be inaccurate or contains an error, you can notify DCI via the contact form.

4-Changes to the content of the Website

DCI is the owner of the Website and reserves the right to change the content at any time and without notice, without being held responsible for the consequences of such changes. Furthermore, DCI reserves the right to interrupt or suspend all or part of the Website’s functionalities and/or its publication at any time and without notice.

5- Hypertext links

5.1- From the Website

To facilitate access to other Websites that may provide additional information to the User, DCI has inserted a certain number of hypertext links on its Website. The insertion of these links is for information purposes only. The choice of links does not imply any ranking or recommendation on the part of DCI.

DCI cannot be held liable for any third party Website to which the User may have had access via the Website. DCI formally declines all responsibility for the content of Websites to which it provides links. DCI has no means of controlling the content of these third-party Websites, and offers these links as a service to the User of the Website. The decision to activate the links belongs exclusively to the User of the Website.

5.2- To the Website

A User of the Website may freely set up a hypertext link to the Website on a website of which it is the publisher. However, they undertake to remove this link at DCI’s first request. Notwithstanding the foregoing, the setting up of hypertext links to the Website is possible subject to the application of the following conditions:

  • It is forbidden to remove, distort or modify the size or appearance of DCI logos;
  • Linking does not imply in any way that we approve of the products and/or services presented on the Website concerned;
  • Linking does not misrepresent the relationship between DCI and the User and/or give false information about DCI;
  • The use of DCI’s trademarks displayed on the Website without the prior written permission of DCI is prohibited;
  • The Website on which the link to our Website is set up must not publish any content, data, text, images, video or audio of a defamatory, offensive or illegal nature, including infringing intellectual property rights or generally not complying with legal and regulatory provisions in force.

Any User who fails to comply with the above conditions may be subject to prosecution by DCI.

6- Information provided by the User

All information provided by the User through the Website, including any data, queries, comments and suggestions sent by the User to DCI, will be treated by DCI as non-confidential information. All information provided by the User to DCI through the Website becomes the property of DCI and may be used freely by DCI.

The User is in no way permitted to access or remain fraudulently in DCI’s information systems under penalty of criminal prosecution in accordance with Article 323-1 of the French Penal Code. The User is also prohibited from posting on and/or providing through the Website any content, data, text, image, video or audio of any kind, including but not limited to any defamatory, offensive or illegal content and/or content that may constitute or encourage conduct that is punishable under criminal and/or civil law. DCI will cooperate fully with any law enforcement and/or judicial authority, including disclosure of the identity of the person concerned.
